Mp George Pantophlet: To Shut Down Or Not To Shut Down.

Recently, I have taken note of some developments on St. Maarten. The most recent one being the shortening of opening hours for nighttime entertainment clubs, bars, restaurants etc. This has brought some thoughts to mind and I will express them via this article. Please note that this is my personal opinion on the matter.

One thing I have learned is that some people will do whatever they want to do without looking at the consequences. What makes matters worse is that their actions can be extremely harmful and even cause death to others Read more

St. Maarten Did Not Break The Agreement

On December 22, 2020 The government of St. Maarten, duly represented by the Prime Minister of St. Maarten, Mrs. S.E. Jacobs hereinafter referred to as: St. Maarten and
The Government of the Netherlands, duly represented by the State Secretary for the interior Ministry and Relations, Mr. R.W. Knops, hereinafter referred to as: The Netherlands;
The aforementioned is the beginning statements of an agreement signed between the St Maarten and Dutch government.

Letter To The Editor: LetS Talk

No Coho like Coho. Let me explain what I mean. There is some kind of entity that might be established, but the Coho will not be that entity. The new entity will and must have the input of the countries Curacao, Aruba and St. Maarten (CAS) because the Coho does not. And it must not as it now does, infringe on National, Kingdom and International Laws.

The State Secretary should not have the final authority when it comes to the process or execution of the packages in other words he should not be placed as judge, jury and executioner Read more

Mp Pantophlet: What Are The Facts

December 17, 2020

What are the facts? Fact is that on September 6, 2017 St. Maarten was struck by a category 5 hurricane named Irma.

Fact is that the islands infrastructure suffered some 90% damage.
Fact is that prior to the passing of said hurricane, St. Maarten was on her way to 3 consecutive Budgets. Fact is that the Dutch did give some support. Fact is that thanks to the insurance pay outs and the savings from individuals and businesses we were well on our way to pre-Irma condition.

Fact is that the Dutch government offered a grant of 550 Euros Read more

Balanced Budgets Unrealistic At This Time

Articles 100 and 101 of St. Maartens State Regulation (Constitution) regulates how St. Maartens Budget has to be established. The procedures are laid out in the compatibility regulations. In my opinion the following articles 15,16 and 25 of the Kingdom Law on Financial Supervision should also be suspended.

Another article which is article 25 of the Kingdom Charter (Statuut van Het Koninkrijk Der Nederlanden) which requires the approval of the Kingdom government should also be suspended Read more

Article 25 Trumps Article 16 Of The Kingdom Law On Financial Supervision.

The conclusion I have come to after reading a letter dated October 19, 2020 sent by the Minister of Finance Ardwell Irion to State Raymond Knops is that article 25 of the Kingdom Law on Financial Supervision trumps articles 16 of the same Law. A text from the advices of the Department of Judicial Affairs and Legislation from the Ministry of General Affairs both from St Read more

Who Says It Is Illegal?

Did the Committee for Financial Supervision Cft say that the Central Bank of Curacao and St. Maarten in announcing that there would be a Naf 75 million issue on behalf of St. Maarten government illegal? Is the Committee for Financial Supervision saying that the management of the Central Bank of Curacao and St. Maarten are ignorant of what the law states regarding the issuance of bonds or loans?

The Committee of Financial Supervision agrees that there is a deficit that was largely caused by covid19 Read more

Is The Kingdom Charter A Democratic Document?

For clarity sake I have freely translated or paraphrased the articles. My apologies if the meaning is lost in the translation, I have attempted to give the English speaking population an understanding of the subject matter.

September 6, 2020

The Kingdom Charter (Statuut van het Koninkrijk der Nederlanden) is said to be the highest law in the Kingdom of the Netherlands. We then have the Grondwet (Dutch constitution), the Staatsregelingen (State Regulations) of Aruba, Curacao and St Read more

No Debt Repayment But Debt Cancellation

The people of St. Maarten so called owes a debt to the Dutch government in the amount of some Ang. 900 million of which I understood we are paying Ang. 12.7 million annually. This means mathematically that at this rate it will take us around 75 years to repay this so called debt which will take us to the year 2095. As we can see this is unattainable and unrealistic. Based on these figures I believe the only realistic request or demand to make, is debt cancellation. This dilemma is not only experienced by St Read more

The Border Issue

August 3, 2020

It saddens me when I hear some people boast about being French and Dutch. These are nationalities imposed on us by the colonial powers who to date maintain political and economic control on this divided paradise. I am of the firm belief and still hold the view that contrary to popular belief that we (displaced Africans of the diaspora) had nothing to do with the signing of the treaty of Concordia because our ancestors were slaves in 1648. if this had been the case then we the local government on both sides would have been able to change it Read more

We Are Not Free

July 17, 2020

I listened to two radio programs on which matters of our constitutional nature were discussed. I dont claim to be a constitutional expert, however it is expected of me as a representative of the people to be knowledgeable of the Constitution of St. Maarten, the rules of order of parliament and the Kingdom Charter amongst others. Note the order in which I listed them, however fact is, the Kingdom Charter is a higher organ than the Constitution of St. Maarten. A statement was made by this person dubbed the constitutional expert that St Read more

Member of Parliament George Pantophlet says that the members of the Caribbean part of the Kingdom are not being treated equally as the members of the European Union. A blind man can see this. Is Issuing Of Pay Slip Compulsory

PHILIPSBURG, Sint Maarten – Member of Parliament George Pantophlet says that he has been receiving numerous complaints about employers who are refusing to issue pay slips to their employees. This unfortunately is not a new phenomenon. He wants to direct these employers to book 7 of the civil code article 1615 n relating to number 14 the flexibilization of the labor laws under 2.2 Obligation pay slips which reads as follows; Old regulation.

Let me inform you that the articles are in Dutch so the following is freely translated by my person;

Under the old regulation there was no explicit regulation to give a pay slip to the employee Read more

We Need Real Relief

I started writing this article on Thursday March 27 but did not send it for publication because I was waiting on the response from the Dutch government on St. Maartens request for legal aid. Article 36 of the Charter.

I want to again congratulate our government and all relevant stakeholders, especially those on the front line such as our healthcare workers, law enforcement, firefighters, civil servants, garbage collectors, the cleaning companies and everyone who is making a combined and concerted effort to combat this dangerous outbreak that has already taken the lives of many and unfortunately is on track to take more lives.

How can I forget the security guards, cashiers at Supermarkets and countless other persons who we dont know, we cannot thank them enough for the courage being displayed at this difficult time Read more
